Thank you for choosing REELRADIO, Inc. ("REELRADIO", "our", "we", "us"). Our Terms and Conditions and Privacy Policy apply to the REELRADIO website and any REELRADIO services (the "Service"). The Service includes the REELRADIO website, any information and content provided on or through REELRADIO, any REELRADIO services, and any software provided on or through REELRADIO.
By registering and/or by using the REELRADIO website in any way, you agree to a binding contract with us and your agreement with us includes these Terms and Conditions and the Privacy Policy (the "Policies").
The Service is not intended for children under 13. By registering and/or using the Service in any way, you certify that you are 13 years or older. Please read our Policies carefully. If at any time you do not agree with our Policies, then you must stop using the Service immediately.
Our Privacy Policy, together with these Terms and Conditions, govern your use of the Service. The Privacy Policy is incorporated into these Terms and Conditions by this reference.
Subscribers should first verify they can access REELRADIO media servers with the machine and Internet service they intend to use. Subscribers will be directed to create an account and provide certain information, including without limitation, a valid email address, and first and last name. You may also optionally provide additional contact information. You agree that all the information you provide REELRADIO will be true, accurate, and current. You may update your email address by going to Modify Account after you sign in to your account.
So that REELRADIO can confirm your registration, you agree to provide a working e-mail address in your subscriber profile on the REELRADIO website. Your registration will expire after six months.
REELRADIO will not share any subscriber registration information with any third-party for any commercial purpose.

You understand and agree that:
(i) REELRADIO is required to provide written confirmation for donations only if they exceed $250 (USD),
(ii) if you want written confirmation for your donation to REELRADIO, you must request such documentation,
(iii) you agree to renew your registration every six months,
(iv) you are not required to donate. Contributions to REELRADIO, Inc. may be tax-deductible, and
(v) if you do not renew your registration within 30 days of expiration, your account and all associated information will be deleted from our system.
Subject to your strict compliance with these Terms and Conditions, REELRADIO hereby grants you the limited, revocable, non-exclusive, and non-transferable right and license to access and make personal, non-commercial use of the Service, provided that YOU WILL NOT:
i. use the Service for ANY illegal purpose, including without limitation, using the Service to violate any legal right of any third party;
ii. use the Service for any commercial purpose;
iii. copy, reproduce, prepare derivative works of, distribute, publicly perform, sell, rent, lease, broadcast, publicly display, transfer, assign, or otherwise exploit any content, elements, or materials that is on or through the Service;
iv. modify, alter, translate, decompile, reverse engineer, reproduce, disassemble, or otherwise gain unauthorized access to any part of the Service;
v. use the Service to take any action or post any information that is harassing, libelous, abusive, defamatory, tortious, threatening, harmful, or otherwise objectionable;
vi. use any of REELRADIO's intellectual property without prior written consent from REELRADIO; and
vii. use any intellectual property or other proprietary right of a third party without prior written consent from such third party.
The Service is licensed, not sold, to you. You acknowledge and agree that any unauthorized copying and/or use of the Service is a violation of these Terms and Conditions.
If you supply airchecks or any other content ("Supplied Content") to REELRADIO, you shall be solely responsible for Supplied Content and the consequences of submitting Supplying Content to the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish all Supplied Content you submit; and you license to REELRADIO on a non-exclusive basis all patent, trademark, trade secret, copyright or other proprietary rights in and to such Supplied Content for publication on the Service pursuant to these Terms of Service.
All rights to the REELRADIO web site, including copyrights and trademarks, remain the property of REELRADIO. You are not granted a right to copy or distribute audio or video files, pictures, text, or any other content from REELRADIO for the purpose of trade or sale, or for any use on other websites.
You may not upload or otherwise knowingly submit to REELRADIO, download, or encourage others to upload or download copyrighted works, trademarks, or other proprietary information without obtaining the prior written consent of the owner of the rights. In the event a user repeatedly infringes a copyright, REELRADIO may, at its sole discretion, cancel the user's rights to use the Service.
If you are a copyright or trademark owner who believes that your rights have been violated on the Service, please send a notice to our Copyright Agent. Such notice should contain an electronic or physical signature of the person authorized to act on behalf of the owner of the copyrighted work, a description of the copyrighted work that you claim has been infringed, a description of where the infringing material is located, your address, telephone number, and email address, and a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner nor any entity authorized to act on the copyright owner's behalf.

A notification of claimed infringement related to the Service should be a written communication addressed to the name and address set forth above, and must include substantially all of the following:
WITHOUT LIMITING ANY PROVISION HEREIN AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS AND REELRADIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, MAKE NO AND HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, GUARANTEES, AND REPRESENTATIONS WITH RESPECT TO THE SERVICE AND YOUR USE THEREOF, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUALITY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.
REELRADIO MAKES NO GUARANTIES, WARRANTIES, OR REPRESENTATIONS ABOUT THE ACCURACY AND COMPLETENESS OF THE SERVICE AND ANY CONTENT OR INFORMATION PROVIDED ON OR THROUGH THE SERVICE. REELRADIO DISCLAIMS ANY LIABILITY TO AND MAKES NO GUARANTIES, WARRANTIES, OR REPRESENTATION THAT: (I) THE SERVICE WILL BE FREE FROM LOSS, DAMAGE, CORRUPTION, DESTRUCTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION; AND (II) THAT USE OF THE SERVICE WILL ACCURATE, TIMELY, UNINTERRUPTED, OR WITHOUT ERROR.
YOU UNDERSTAND THAT SOME OF THE CONTENT AVAILABLE ON OR THROUGH THE SERVICE MAY INCLUDE MATERIALS OR INFORMATION THAT BELONG TO THIRD PARTIES. YOU ACKNOWLEDGE THAT REELRADIO ASSUMES NO RESPONSIBILITY FOR SUCH CONTENT. CERTAIN STATE LAWS DO NOT ALLOW DISCLAIMERS OF OR LIMITATIONS ON IMPLIED WARRANTIES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE SHALL BE AT YOUR OWN RISK. YOU RELEASE REELRADIO FROM AND IN NO EVENT SHALL REELRADIO BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES SUFFERED BY YOU IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DAMAGES RESULTING FROM: (I) ANY ERRORS, SERVICE INTERRUPTIONS, SOFTWARE FAILURE; (II) ANY INACCURACIES, MISTAKES, OR OMISSIONS OF CONTENT PROVIDED ON OR THROUGH THE SERVICE; (III) BUGS, VIRUSES, OR TROJAN HORSES; AND (IV) ANY UNAUTHORIZED ACCESS TO OR USE OF PERSONAL INFORMATION PROVIDED ON OR THROUGH THE SERVICE.
Subscribers agree and understand that REELRADIO makes no representations concerning the quality, quantity, accuracy, frequency of updates, reliability or other characteristics of service.
You acknowledge and agree to indemnify, defend, and hold harmless REELRADIO, its officers, directors, shareholders, employees, and agents, from and against any claims, damages, losses, liabilities, costs (including but not limited to attorneys fees and/or other costs associated with resolution or defense of the claim) arising from your misuse of our Policies and/or a breach of our Policies.
Subscriber agrees to use the Service in a manner consistent with any and all applicable laws and regulations of the United States of America, the State of California, and the Member's locality.
REELRADIO reserves the right to cooperate with law enforcement and other authorities, at its sole discretion, in investigating claims of illegal activity.
REELRADIO reserves the right to suspend or cancel the Service to you and to the general public, at any time, and without notice, for any reason, including but not limited to, the inability of REELRADIO, Inc. to receive funding sufficient for the continuing operation of the organization sponsored services.
Nothing contained in our Policies shall be construed to limit action REELRADIO may take or remedies available to REELRADIO in any way. In addition, REELRADIO reserves, at all times, all rights and remedies available to REELRADIO. Non-enforcement of any published policy or rule does not constitute consent or waiver, and REELRADIO reserves the right to enforce such policy or rule at its sole discretion.
REELRADIO RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS SUBSCRIPTION FEES AND BILLING METHODS, INCLUDING THE ADDITION OF SUPPLEMENTAL FEES OR SEPARATE CHARGES FOR CONTENT OR SERVICES PROVIDED BY REELRADIO, UPON EFFECTIVE NOTICE TO YOU, WHICH SHALL INCLUDE NOTICE SENT TO YOUR DESIGNATED EMAIL ADDRESS OR NOTICE ON THE SERVICE. If any such change is unacceptable to you, you may cancel your account and discontinue use of the Service.
REELRADIO may modify these Terms and Conditions at any time, effective immediately with publication on the REELRADIO website. Your use of the Service after such notice shall constitute your acceptance of the modifications to our Policies.
These Terms and Conditions are governed by, and will be construed under, the laws of the United States and the laws of the State of California. All disputes arising out of or related to your use of the Service shall be subset to the exclusive jurisdiction of the state and federal courts located in Sacramento, California and you agree to submit to the personal jurisdiction and venue of such courts.
